Proposal to revise the regulation on plastics in contact with foodstuffs

The draft regulation contains several important changes to Annex I of Regulation (EU) No 10/2011.

>    Revoking the authorisation for substance No 96 (wood flour and fibres, untreated) and 121 (salicylic acid) in the EU list. Food contact plastics made with salicylic acid or untreated wood flour or fibres from a specific wood species may continue to be available commercially for the first time, eighteen months after the date of entry into force of the amendment, but subject to authorisation and other conditions.

>    Replacing nine FCM substances, including enhanced specific migration limits (SML) for DBP (2.5 times), BBP (5 times) and DEHP (2.5 times) and new requirements for the restriction of substances in the group (total SML).

>    Adding five new entries.

>    Replacing three entries in the substance group restriction, including the consideration of DIBP in group restriction No. 32

>    Adding three new entries to the group restriction of substances, including group restriction No 36, where the sum of four phthalates (DBP, BBP, DEHP and DIBP) is expressed as DEHP equivalents.

AThe following are the main dates to take into account:

>    Adoption: March 31st 2023

>    Publication: April 3rd 2023

>    Entry into force: twenty days after publication in the Official EU Journal
