Intention for the inclusion of new substances under the mantle of application of the Reach

On October 5, the European Commission published a draft amendment to Regulation (EC) No. 1907/2006 of the European Parliament and of the Council regarding carcinogenic, mutagenic or reproductive toxic substances subject to restrictions.

This draft Commission Regulation intends to include in the scope of entries 28 to 30 of Annex XVII of Regulation (EC) No. 1907/2006 several substances, with the effect of restricting their marketing or use for supply to the public in as substances alone, as constituents of other substances or in mixtures and impose a requirement to mark containers with the label ‘restricted to professional users‘.

This is a consequence of the recent classification of these substances as CMR category 1A or 1B under Regulation (EC) No. 1272/2008 of the European Parliament and of the Council, of December 16, 2008, on the classification, labeling and packaging of substances and mixtures, modified by Commission Delegated Regulation (EU) 2022/692 (modified, DO L 146 of 5.25.2022, p. 150).

The proposed date of adoption is the second quarter of 2023.
